This note is prepared to provide guidance to clients who are purchasing properties with our assistance. It is intended to be a guide to different disbursements and fees that are charged when the trasaction is carried out.

Stamp Duty Land Tax
Freehold and Existing Leases

This is a tax paid to the Inland Revenue and is calculated as a percentage of the purchase price. If the purchase price is below £120,000 or £150,000 in a disadvantaged area no stamp duty is payable.

Shared Ownership New Leases

This is a tax paid to the Inland Revenue and is calculated as a percentage of the full market value (option A) for freehold and existing leasehold properties, or as a percentage of the purchase price plus a percentage of the annual rent (option B). If the lease term is for 100 years or less, stamp duty is calculated by reference to12% of the annual rent plus 1% of the purchase price. If the lease term is in excess of 100 years, stamp duty is calculated by reference to 24% of the annual rent plus 1% of the purchase price. Under option A you do not have to pay additional stamp duty if you buy additional shares in the property. Under Option B you may be required to pay stamp duty if you buy additional shares in the property. If the property is in a disadvantaged area and the initial market value of the property is below £150,000 no stamp duty is payable. If the property is in a disadvantaged area and the initial market value is above £150,000 but the purchase price is below £150,000 stamp duty is payable by reference to the annual rent only.

Land Registration Fee

This is a fee paid to HM Land Registry to register your title and any mortgages over the property. The fee is calculated by reference to the purchase price.

Local Authority Search Fee

A Local Authority search is an official enquiry of the Local Authority to reveal any planning decisions or notices that affect the property. If you are obtaining a mortgage it is a requirement of the offer that a local Authority search is carried out. Local Authority searches must be paid for in advance and normally takes between two and three weeks to arrive.

Your mortgage lender may allow a personal search instead of a Local Authority search. A Personal Search is where we send an agent into a Local Authority's offices to undertake the searches on your behalf. A Personal Search fee is generally cheaper and the results usually arrive within 5 working days.

Telegraphic Transfer Fee

This is a bank charge for forwarding the purchase money to the seller's solicitor by instantaneous electronic transfer on the day of the purchase.

Land Registry Search Fee

This is a fee payable to HM Land Registry. The search reveals if there are any recent adverse entries on the title. The search also creates a priority in any dealings by the buyer. This is to prevent anyone placing an adverse entry on the title before it can be registered in the buyer's name.

Bankruptcy Search Fee

This search is put in place to protect the mortgage lender and is to ensure that you are entitled to purchase the property.

Leasehold Properties

This is a notice served on the Landlord giving details of your mortgage.

Notice of Assignment Fee
Leasehold Properties

This is a notice served on the Landlord giving details of the purchase/assignment.

Printing of Lease Fee
New Leasehold Properties

This is a fee payable to the Landlord's solicitor for printing the engrossed lease. The fee will vary from property to property. You could pay between £50 and £95 for this disbursement.
